  • This website is operated by CosmicAbyssStudio LLC. Throughout the site, the terms “we”, “us” and “our” refer to CosmicAbyssStudio LLC. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. Our store is powered by Shopify Inc., which provides us with the online e-commerce platform to sell our products to you. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.


 

SECTION 1 - ACCESS & ACCOUNT TERMS 

  • By accessing or using the Service, you represent that you are at least the age of majority in your jurisdiction of residence, or that you have obtained appropriate consent from a parent or legal guardian where required by applicable law.

    To access certain features of the Service, including browsing our online store or purchasing products, you may be required to provide accurate, current, and complete information, including your email address, billing details, payment information, and shipping address.

    You represent and warrant that all information provided to CosmicAbyssStudio LLC is truthful, accurate, and that you are authorized to provide such information.

    You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities conducted under your account.

    You may not transfer, sell, assign, or sublicense your account to any third party.

    We reserve the right to refuse service, terminate accounts, cancel orders, or restrict access to the Service at our sole discretion, including where fraudulent, abusive, or suspicious activity is suspected.

SECTION 2 - PRODUCTS & MATERIAL DISCLAIMER 

  • We strive to display our products and services as accurately as possible through our online store. However, due to differences in device displays, screen settings, lighting conditions, and the handcrafted nature of our original design products, actual product colors, textures, and appearances may vary from what is displayed online.

    You acknowledge and agree that minor variations in appearance, texture, coloration, surface detail, or structural characteristics are inherent to handcrafted and small-batch production processes.

    Handcrafted & Material Characteristics: Products created through artisanal methods, cement casting, molding, curing, layering, additive manufacturing, or other specialized production techniques may naturally contain subtle surface textures, tonal variations, micro air pockets, fine lines, or other unique material characteristics. These characteristics are considered normal aspects of the manufacturing and artistic process and shall not generally be considered defects or grounds for return, refund, or replacement.

    We reserve the right, at our sole discretion, to modify product descriptions, product availability, and pricing at any time without prior notice.

    We further reserve the right to discontinue products or limit the sale of products or services to any individual, region, or jurisdiction on a case-by-case basis.

SECTION 3 - ORDERS, CANCELLATIONS & COMMERCIAL RESTRICTIONS 

  • Any order submitted through our online store constitutes an offer to purchase. An order is not accepted by CosmicAbyssStudio LLC until payment has been successfully processed and a formal order confirmation email has been issued.

    Please review your order carefully before submitting it. Due to our handcrafted production and fulfillment schedule, once an order has been confirmed, we may not be able to accommodate cancellation or modification requests.

    We reserve the right, at our sole discretion, to refuse, limit, modify, or cancel any order for any reason, including but not limited to pricing errors, inventory limitations, carrier restrictions, suspected fraud, resale activity, or other circumstances that may affect fulfillment. If we cancel an order after payment has been processed, we will issue a refund for the cancelled portion of the order.

    Your purchase is intended solely for personal use or household reptile husbandry. Commercial resale, redistribution, or unauthorized export of our products is prohibited without our prior written consent.

    Returns and exchanges are subject to our Refund Policy.


SECTION 4 - PRICING, BILLING & INTERNATIONAL DUTIES 

  • Prices posted on our online store do not include shipping fees, handling fees, import duties, Value Added Tax (VAT), customs fees, or any other taxes imposed by the destination country unless otherwise stated.

    For all international orders, the buyer is solely responsible for customs clearance and for paying all applicable import duties, taxes, VAT, and related fees required by the destination country.

    If a shipment is refused, abandoned, or returned due to unpaid customs fees, import taxes, or failure to complete customs clearance, the customer shall remain responsible for all shipping charges, return shipping fees, customs charges, and any related expenses incurred.

    We are not responsible for delays caused by customs processing, international shipping carriers, or local import regulations.

    You agree to provide current, complete, and accurate billing and payment information for all purchases made through our store. You represent and warrant that you are authorized to use the payment method provided, and that all charges incurred will be honored by your financial institution.

SECTION 5 - SHIPPING, ORIGIN & RISK OF LOSS 

    1. All orders are carefully packed and fulfilled directly from our Production Studio located in Taiwan.

      Fulfillment & Timelines: Because each cement hide is individually handcrafted, our standard handling time is approximately 10 business days. Estimated international transit times range between 14–30 business days depending on destination country and customs processing. All shipping and delivery dates are estimates only and are not guaranteed.

      Risk of Loss & Title Transfer: Title to, and risk of loss for, all purchased goods transfer to the buyer immediately upon our delivery of the shipment to the international carrier (including but not limited to Chunghwa Post EMS, international air mail carriers, or local postal services such as USPS).

      We are not responsible for delays, losses, damages, or delivery failures caused by customs inspections, carrier disruptions, weather conditions, local import regulations, force majeure events, or circumstances beyond our reasonable control. However, we will make reasonable efforts to assist customers with shipment tracking and carrier claims where applicable.

SECTION 6 - INTELLECTUAL PROPERTY RIGHTS 

  • The Service and all content included within it — including but not limited to our original “Xeno-organic” aesthetic concepts, sculptural cement reptile hides, product designs, visual identities, logos, brand names, artwork, text, graphics, photographs, videos, and related creative materials — are the exclusive intellectual property of CosmicAbyssStudio LLC or its licensors and are protected by United States and international copyright, trademark, trade dress, and other applicable intellectual property laws.

    You are granted a limited, non-transferable, non-commercial license solely to access and use this website for personal use. No ownership rights or intellectual property rights are transferred to you through use of the Service.

    Without our prior written consent, you may not reproduce, copy, modify, distribute, sell, commercially exploit, or create derivative works based upon any portion of our designs, branding, content, or products.

    We reserve all rights not expressly granted under these Terms and may pursue any available legal remedies for unauthorized use of our intellectual property to the fullest extent permitted by law.


SECTION 7 - OPTIONAL THIRD-PARTY TOOLS 

  • We may provide access to third-party tools, applications, or services (including but not limited to live chat systems, shipment tracking platforms, social media integrations, or customer support tools) which we neither monitor nor control.

    You acknowledge and agree that such tools are provided “as is” and “as available” without warranties, representations, or conditions of any kind, whether express or implied.

    Your use of any optional third-party tools is entirely at your own risk and discretion, and you should ensure that you understand and agree to the applicable terms provided by the relevant third-party providers.

    We shall not be liable for any damages, losses, or issues arising from your use of third-party tools or services.

    Any future features, services, tools, or resources introduced through the website shall also be considered part of the Service and subject to these Terms.

      However, all sales, purchases, transactions, and contractual relationships made through this website are solely between you and CosmicAbyssStudio LLC.

      By using this Service, you acknowledge and agree that Shopify is not responsible for any aspect of any transaction, purchase, product, service, injury, loss, damage, or claim arising from your relationship or transactions with CosmicAbyssStudio LLC.

    We are not obligated to honor pricing, availability, or promotional errors resulting from typographical mistakes, technical malfunctions, system issues, or unintended inaccuracies.

    (g) to impersonate another individual or entity, provide false information, or engage in deceptive conduct; or

    The following provisions shall survive termination of these Terms: Intellectual Property, User Feedback & Submissions, Prohibited Uses, Automated Access & Agent Control, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Privacy & Data Processing, and any provisions which by their nature should reasonably survive termination.

    This includes, without limitation, damages relating to loss of profits, loss of revenue, loss of savings, data loss, replacement costs, animal injury, habitat-related issues, behavioral changes, biological incompatibility, or any other commercial, personal, or consequential losses.

    Animal Habitat & Biological Use Products:
    For products used within reptile enclosures, animal habitats, bioactive systems, or pet care environments, the customer is solely responsible for determining species compatibility, habitat suitability, environmental conditions, structural placement, and safe usage for their specific animals.

    To the fullest extent permitted by law, CosmicAbyssStudio LLC shall not be liable for injuries, illnesses, stress responses, behavioral changes, habitat-related issues, property damage, or fatalities involving animals arising from the use, misuse, placement, wear, environmental exposure, modification, or incompatibility of our products.

    For all other decorative, wearable, collectible, or lifestyle products, our total aggregate liability shall not exceed the actual purchase price paid for the specific product giving rise to the claim.

    Some jurisdictions do not allow the exclusion or limitation of certain liabilities or damages, so portions of this limitation may not apply to you.
